Western Australia Work Health and Safety Regulation Updates

The West Australian Department of Mines, Industry Regulation and Safety has recently updated Work Health and Safety regulations. The new regulations came into effect on March 31st, 2022. The acts cover general workplaces, mining operations and petroleum and geothermal energy operations with many of the regulations consistent across all three sectors.

The new legislation aims to modernise the work health and safety laws for Western Australia. The new laws are based on the national model WHS Act and Regulations used in every other state and territory except Victoria.

The new Act replaces the following legislation:

  • Occupational Safety and Health Act 1984,

and, the work health and safety elements of the following Acts, covering mining and petroleum:

  • Mines Safety and Inspection Act 1994
  • Petroleum and Geothermal Energy Resources Act 1967
  • Petroleum (Submerged Lands) Act 1982
  • Petroleum Pipelines Act 1969.
